Agreed. Though I still think the pressing charges aspect should require the victim's permission. I'll be talking about the Spanner case (http://www.spannertrust.org/documents/spannerhistory.asp) in my later essay - in which several 'victims' were also tried for being accessory to their own assault, having been engaged in consensual BDSM activities. The law has not changed. Clearly rape is not the same exact issue, but where neither victim nor accused is interested in taking the charge to court, I don't see how it is in the state's interest to do so.
